.18. Foreclosure Notices and Registrations
The Office administers Maryland's Foreclosure Registration System, a web-based application for submission of the foreclosure-related notices and registrations that are mandated by Maryland law. Specifically, the system allows licensed users to send and/or browse the following foreclosure-related notifications and registrations:
- The Notice of Intent to Foreclose is a warning notification to the property owner that a foreclosure action could be submitted against them in court. It needs to be sent out by certified and top-notch mail to the property owner no less than 45 days before a foreclosure action may be in court. Pursuant to Maryland law and regulation, a copy of the Notice of Intent to Foreclose must be electronically sent to the Commissioner through the Foreclosure Registration System within 5 service days of sending by mail a Notification of Intent to Foreclose. The Commissioner does not accept submissions in any other way. Filing a copy of the Notice of Intent to Foreclosure with the Commissioner should be achieved before a party is authorized to file an action to foreclose a mortgage or deed of trust on house. Failure to comply with this requirement will subject a violator to the enforcement jurisdiction of the Commissioner. Describe Md. .14. After Initial Registration, and within 21 organization days of a change, a foreclosure buyer need to update its registration with any modification in 1) the name and address of the person, consisting of a substitute buyer, who is licensed to accept legal service for the foreclosure buyer, 2) if known, the occupancy/vacancy status of the residential or commercial property, 3) the name, telephone number, and street address of the individual who is responsible for the upkeep of the residential or commercial property, and 4) the status of whether the foreclosure buyer has possession of the residential or commercial property.
NOTE: Specific notification and registration details in the Foreclosure Registration System is generally confidential and is not public info. Maryland State and Local Government Officials may be licensed in their main capability to see Notices of Foreclosure or Foreclosed Residential Or Commercial Property Registrations (for their respective jurisdictions only) by developing a Federal government User account in the Foreclosure Registration System. Additionally, a house owner's association or condominium in which a residential or commercial property in questions is located, or a person who owns residential or commercial property on the exact same block as a residential or commercial property in question, may ask for from OFR or regional jurisdiction specific details related to a Notification of Foreclosure or Foreclosed Residential Or Commercial Property Registration. Except as kept in mind above, OFR is forbidden from providing details relating to specific residential or commercial properties to the public. System users other than State and regional government authorities just have access to those notices and registrations that they have actually sent. The Office is not allowed to offer lists of foreclosed residential or commercial properties to the public.
